1. General & Agreement to Terms of Use

This website is operated by JMC KO. BY USING THIS SITE AND ALL OTHER ASSOCIATED SITES AND SUBSIDIARIES LINKED TO www.jmcko.com, YOU AGREE TO THESE TERMS AND CONDITIONS; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

JMC KO, at its sole discretion, reserves the right to change or modify these Terms and Conditions at any time. You are responsible for checking these Terms and Conditions for any modifications and changes. These Terms and Conditions or any future modifications to these terms constitute the agreement between JMC KO and you, and any deviating agreements shall require written consent from JMC KO.

2. Quotes and Published Prices

Any offers and quotes made by JMC KO for products and services are non-binding.

All published prices are listed excluding any sales tax, and the prices applied to any orders shall be the prices in force on the day of the order, unless agreed to in written consent from JMC KO. Published prices are subject to change at any time without notice and JMC KO reserves the right to change, suspend, or discontinue services at any time without notice.

3. Purchase Orders and Contracts

All purchase orders must be approved by JMC KO in a form specifying products and/or services along with any appropriate customer information. The approval or rejection of purchase orders is solely up to JMC KO’s absolute discretion, for any reason.

4. Returns, Exchanges & Refunds

4.1 Right of Cancellation

You are entitled to cancel your order within 7 days without giving any reason.
The deadline for canceling is 7 days from the date you received the goods or on which a third party you appointed, who is not the carrier, took possession of the goods.

To exercise your right of cancellation, you must notify us clearly by e-mail: jmckousa@gmail.com.

We will reimburse you no later than 14 business days from the day we receive the returned goods. Refunds will be made using the same payment method as the original purchase, and no additional fees will be incurred.

4.2 Conditions for Returns

For goods to be eligible for return:

• They must have been purchased within the last 7 days.

• They must be unused, in original packaging, and not a clearance or sale item.

Non-returnable items include:

• Custom or personalized goods.

• Goods not suitable for return due to their nature (e.g., items that deteriorate quickly or are past expiry).

• Goods unsealed after delivery that are unsuitable for return due to hygiene or health reasons.

• Goods inseparably mixed with other items after delivery.

• Clearance, "as-is," or previously used goods.

We reserve the right to refuse returns at our sole discretion if these conditions are not met.

4.3 Returning Goods

Buyer is responsible for all costs and risks of returning goods. Items must be shipped to:

We cannot be held responsible for goods lost or damaged in return shipping. We recommend insured, trackable shipping. Refunds cannot be processed without actual receipt or proof of delivery.

4.4 Restocking Fee

All eligible returns are subject to a 35% restocking fee. Refunds will be issued as credit to Buyer’s account unless otherwise agreed.

5. Governing Law

These terms and conditions and any other agreements with JMC KO relating to product purchases or services shall be governed by and construed in accordance with the laws of Buena Park, California. JMC KO reserves the right to initiate court proceedings against Buyers at any other court of appropriate jurisdiction.

6. Shipping and Handling

All purchases require an accurate name of Buyer and shipping address of Buyer. Shipping dates are estimates unless expressly agreed in writing. JMC KO will make reasonable efforts to meet estimated delivery times, contingent upon Buyer providing all necessary information.

JMC KO is not responsible for damages or losses due to delays. At Buyer’s risk, items may be stored and handled by JMC KO if Buyer causes shipment delays. Buyer assumes storage, insurance, and handling costs.

All shipments heading to JMC KO must be pre-approved by an authorized JMC KO representative. Video and photo documentation of the packages must be provided in advance, and the packages must be explicitly approved by the representative before acceptance.

Force majeure events release JMC KO from delivery commitments. Buyer may withdraw from contract only after a reasonable grace period if delivery dates are not met.

7. Limitation of Liability

JMC KO is not liable for any indirect, incidental, or consequential losses in damages, injuries, profits, or expenses due to breaches of obligations whether based on contract, tort, strict liability, or otherwise.

8. Indemnity

Buyer agrees to indemnify and hold harmless JMC KO, its employees, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, and suppliers from any demands or claims (including legal fees) arising from third-party breaches of these Terms or violations of law.

9. Tax

Where required by law, JMC KO will collect applicable taxes from Buyer. If Buyer has a valid tax exemption certificate, it must be provided before final purchase approval.

10. Payment Terms

Unless otherwise agreed by JMC KO, all transactions are COD (Cash on Delivery). Immediate payment is required before an order can be shipped as reflected on the invoice.

11. Export Control

For products or services subject to export control laws, Buyer is solely responsible for compliance with applicable regulations in their country. Buyer agrees to indemnify JMC KO against any violations of such restrictions.

12. Right to Refuse Service

JMC KO reserves the right, at its sole discretion, to refuse service, cancel orders, or terminate accounts if a Buyer engages in abusive, fraudulent, unlawful, or otherwise inappropriate conduct, or if fulfilling the order is not feasible.
